MAGISTRATES COURT - PRIVATE COSTS

Magistrates Court
Guilty Plea - When you appear in the Magistrates Court for your first appearance you will be asked to enter a plea. If you plead guilty, for less serious matters, the court will try and deal with you there and then. (For instance the less serious road traffic cases). For matters that require a report by the Probation Service usually the matter is adjourned for around 6 weeks. At the next hearing it is expected the matter is finalised. If the case is so serious that a custodial sentence is given this may be dealt with on the first hearing. For some serious offences the Magistrates send the case to the Crown Court for sentence. The Crown Court hearing is usually a month later.
Not guilty – if you appear and enter a not guilty plea and the case is to be tried in the Magistrates Court the case will be adjourned for a trial. The length of the adjournment is dependent on a number of factors but most importantly how booked up the court slots are. The delay can be anything from 2 months to 6 or 7 months – it is difficult to be precise.
Crown Court
Guilty – sent to Crown Court. It is expected that you would be sentenced at the first hearing in the Crown Court (4 weeks after your Magistrates Court appearance) but sometimes there has to be a delay for a Pre-Sentence Report if it has not already been ordered by the Magistrates Court and a Judge agrees.
Not guilty – if your case is sent to the Crown Court for trial then there is usually a Plea and Trial Preparation Hearing (PTPH) in the Crown Court within a month. Again, it is difficult to give a time estimate for a trial listing but it is at least 3 months and often much longer.
